Terms of Service

Effective: December 2017

These customer terms forms a contract between customer and Questmark as part of an overall contract against Questmark's terms and conditions. “we”, “our”, “us” refers to Questmark Limited.

Who is the customer

There is only one customer. Customer is the person who represents the organisation as the organisation admin in this service unless overridden in the terms and conditions or where multiple admins are present. In this case the customer is determined by the domain used by the organisation admins.

What this means to the customer

The customer will submit data through access to our service. Examples are providing directory information, scheduling events, creation, addition and deletion of accounts or creation, addition and deletion of devices. This is done under the choice of the customer and instructions of such may result in the access, use, disclosure, modification, deletion of certain or all customer data. Please review our help centre documentation for information about these choices and instructions.

Feedback is welcome

We appreciate any suggestions or feedback Customer may provide. If any feedback or suggestions are implemented, Customer grants us royalty free license to use any such feedback or suggestions for any purpose without obligation or compensation to Customer. By default, Customer allows us to use their name and logo for any marketing or publicity material unless written notification is sent by Customer and acknowledged by us.

Non-questmarkvc.com products

Our services include products and integrations that aren’t directly developed by us but may be used by the customer in part of our service. These are not our services, so we do not warrant or support these non-questmarkvc.com products, and, ultimately, customer (and not us) will decide whether or not to include such products as part of our service. Any use of a non-questmarkvc.com product is solely between customer and the applicable third party provider. Please be mindful of any customer data shared with such parties and the purpose they require such data and we will take no responsibility for any use, disclosure, modification or deletion of customer data that is access by a non-questmarkvc.com product.

Use of the service

Customer must comply with the contract and ensure all users under the customer account comply with the contract. We retain to right to review compliance with any contract without notice but aren’t required to by any obligations made. We aren't responsible for the content of any customer data or the way customer chooses to use the services to store or process any customer data. Customer is solely responsible for providing high speed internet service for itself and to provide suitable computing resource to access and use the Services.

Our responsibilities

To provide the service to customer as described in the contract in accordance with our then-current help centre documentation pages and subject content provided on this website that comply with such contract. Be assured that throughout any duration of contract the service will not decrease in functionality unless stated in any modification to contract and perform as to our deemed satisfaction levels. For any breach of warranty refer to Terms and Conditions. We will make the services available to customer and it’s authorised users 24 hours a day, 7 days a week excluding any planned downtime periods. We will not publish any customer data without prior written instructions except where “feedback is welcome” section applies. We make protecting customer data our top priority and will maintain administrative, physical and technical safeguards in accordance to our ISO:27001 code and conducts. Those safeguards mentioned in such codes and conducts include the prevention of unauthorised access, use, modification deletion and disclosure of customer data by our personnel. We reserve the right to notify all users regarding any updates to our services. These updates will include any information relating to the updates, including any help centre articles where necessary. It is the responsibility of the customer to provide adequate safeguards for protection and backup of customer data when in customer’s or third party possession or when customer deems not to encrypt data transmissions with any of our service. We are not responsible for customer, customer users or non-questmarkvc.com products handling of customer data.

Relationship of the parties

The parties are independent contractors. The Contract does not create a partnership, franchise, joint venture, agency, fiduciary or employment relationship between the parties. There are no third party beneficiaries to the Contract.

Disclaimer of warranties

Customer represents and warrants that it has validly entered into the contract and has the legal power to do so. Customer further represents and warrants that it is responsible for the conduct of its users and their compliance with the terms of this Contract and the general terms and conditions. Service is provided on an “as is” and “as available” basis, except as specifically provided herein, to the fullest extent permissible pursuant to applicable law, we expressly disclaims all warranties of any kind, whether express, legal or implied, including, without limitation, any warranties of merchantability, fitness for a particular purpose and non-infringement. We do not make any warranty that service will meet your requirements, or that access to the service will be uninterrupted, timely, secure, or error-free, or that defects, if any, will be corrected. we make no warranties as to the results that may be obtained from the use of service or as to the accuracy, quality, or reliability of any information obtained through the service. You understand and agree that any material and/or data downloaded or otherwise obtained through the use of service is used at your own risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of such material and/or data. No advice or information, whether oral or written, obtained by you from site owner or through the service shall create any warranty not expressly made herein.


As our service evolves, our contracts with customer may evolve with them and we reserve the right for any modifications to be made. Reasonable advance notice will be given of any change where possible but isn’t a mandatory requirement. Customer can view the latest alliteration of their current terms of service contract by visiting this page. Any changes made to the contract by us will be deemed live on representation on this page and the date of effect stated. If a customer uses any part of the service after the effective date, this is deemed their acceptance of any revised terms and conditions.
